Legal Information
Terms & Conditions
Pristine Windows and Guttering
These Terms and Conditions form a legally binding agreement between Pristine Windows and Guttering (a trading name of Gina Davis, sole trader) and the customer.
By booking our services, you confirm acceptance of these Terms and Conditions.
1. Services Provided
We provide professional exterior cleaning services including window cleaning, gutter clearance, fascia, soffits, conservatories, and related exterior surfaces.
All services are carried out using appropriate methods and equipment. Results may vary depending on the condition, age, and previous maintenance of surfaces.
For water-fed pole cleaning systems, initial cleans on previously traditionally cleaned or heavily soiled properties may result in temporary spotting or runoff, which typically reduces with ongoing maintenance cleans.
2. Contract Formation
A contract is formed when:
- A booking is confirmed verbally, by message, email, or written agreement, or
- Work is carried out following a request from the customer
The customer is responsible for ensuring all booking details are correct.
3. Pricing and Payment
- Payment is due within 14 days of invoice date, unless otherwise agreed in writing.
- Accepted payment methods: bank transfer or cash.
- Bank transfers must include the customer’s address as a reference.
If payment is not received:
- After 30 days, services will be suspended
- After 60 days, the debt will be referred to debt recovery or small claims court
The customer remains liable for all outstanding balances and any reasonable recovery costs.
4. Cancellations and Missed Appointments
We require a minimum of 7 days’ notice for cancellations or rescheduling.
If less than 7 days’ notice is given, or access is not provided on arrival:
- The full agreed price may be charged
Where repeated late cancellations occur, we reserve the right to withdraw ongoing services.
This clause reflects loss of earnings due to reserved appointment time.
5. Regular Service Agreements
For customers on a recurring schedule (4, 6, 8, or 12-week cycles):
- A minimum of 2 cleans is required before cancellation
If cancelled before completion of 2 cleans, the remaining balance of those two cleans becomes immediately payable.
6. Access to Property
The customer must ensure safe and reasonable access to all agreed areas.
If access is restricted (locked gates, obstructions, unsafe conditions), we may:
- Clean only accessible areas, or
- Cancel the visit and apply the full charge
We are not responsible for moving items such as furniture, ornaments, plant pots, or personal belongings.
7. Weather and Safety
We reserve the right to postpone or reschedule work due to unsafe conditions including but not limited to:
- Heavy rain
- Snow or ice
- High winds
- Unsafe working conditions
No liability is accepted for delays caused by weather or safety concerns.
8. Customer Responsibilities
The customer agrees to:
- Ensure windows and doors are closed before cleaning
- Inform us of any known defects or issues (e.g. leaks, loose seals, fragile fittings)
- Ensure safe access is available
We accept no liability for issues caused by pre-existing defects or failure to meet these responsibilities.
9. Liability and Limitations
We hold public liability insurance up to £1,000,000.
We are not liable for:
- Pre-existing damage or structural defects
- Water ingress caused by open, faulty, or poorly sealed windows/doors
- Damage caused by deteriorating frames, seals, or fittings
- Oxidation, fading, or natural wear revealed during cleaning
- Internal water damage where access points are not sealed
Our cleaning methods are designed to be safe when used on properly maintained surfaces.
Nothing in these Terms excludes liability for death or personal injury caused by negligence or any liability which cannot legally be excluded under UK law.
10. Complaints and Rectification
Any complaints must be reported within 24 hours of service completion.
After this period, it may not be possible to verify or rectify issues.
Where valid concerns are raised within the timeframe, we will aim to inspect and rectify where reasonably necessary.
11. Force Majeure (Events Outside Our Control)
We are not liable for failure or delay in performance caused by events outside our reasonable control, including (but not limited to):
- Extreme weather
- Accidents or vehicle breakdown
- Illness
- Supply chain disruption
- Government restrictions
In such cases, appointments will be rearranged at the earliest reasonable opportunity.
12. Limitation of Liability
Our total liability for any claim arising from our services is limited to the total amount paid for the specific service in question.
We are not liable for any indirect or consequential losses.
13. Data Protection
We only collect personal information necessary to provide our services.
Customer data is:
- Stored securely
- Not sold or shared with third parties
- Used only for scheduling, invoicing, and communication
We comply with UK GDPR requirements.
14. Variations to Terms
We reserve the right to update these Terms and Conditions at any time. The latest version will apply to all future bookings.
15. Entire Agreement
These Terms represent the entire agreement between both parties and override any prior verbal or written agreements.
